Three Articles for Research Paper

Reno Gazette-Journal: Health-care rule violates the U.S. Constitution

http://www.thetowntalk.com/apps/pbcs.dll/article?AID=/201202100245/OPINION/202100314

Summary: This article is basically saying that the new healthcare rule that requires birth control to be included with insurance goes against the First Amendment and that the Federal Government has no right to go against the freedom of religion. This healthcare bill is not an argument about abortion, it is about the fact that the government is telling the church to do something that goes against the Constitution.

Washington Post Opinion Article by Charles Krauthammer

Summary: President Obama's accommodations was merely just an accounting trick and it still forces Catholics and all other religious institutions to provide medical insurance that guarantees free birth control. Now this is important too because with this new mandate if birth control was required to be given out for free then that is another huge financial burden for private businesses to give away free services. This article also lists out Constitutional wreckage left by Obamacare.

Washington Post: you cant compromise on religious liberty

Summary: This article is talking about how the liberal government needs to keep religion out of politics. This healthcare grants broad administrative regulatory authority that bypasses congress. The Obama Administration's Department of Health and Human Services (HHS) did nothing to fix the unconstitutional part that people are forced to pay for birth control in the new "accommodations" it was just merely worded differently. This is not just an assault on Catholics, it's an assault on all
religious institutes.

Research Paper

Is Obama's healthcare unconstitutional and go against First Amendment?
Does the government have the right to pass this bill?
If Obama does not change the bill, what will come of this?

There is a huge debate going on in today's news about Obama's healthcare being unconstitutional. This health care not only affect the Catholics, but also affects all people of the faith. Does the American government have the right to go against religious institutions and their faith? Obama cannot force a religious institution to go against their beliefs because it is unconstitutional. He recently made "accommodations" to the healthcare bill saying that the religious institutions will not have to pay for the contraceptives directly, and they will just be paying for the insurance. Are these really accommodations? No because even if it is indirect, forcing these religious institutions to go against their faith is violating the First Amendment Free Exercise Clause which separates the power of church and state. The religious institutions are paying for the insurance plans and these insurance plans carry with them the authorization to provide free contraception and abortion pills. This debate is very important for our nation today because if the government goes against the Constitution with the church and gets away with it, this will just open the door for the government to push other things as this on our nation. This is exactly what our founding fathers have feared. The government is basically telling people they have to go against their religious beliefs and faith. Because of this, the debate is bigger than the Catholic Church, it affects all religious institutions in America.

Senator Blunt said, "It’s still clear that President Obama does not understand this isn’t about cost – it’s about who controls the religious views of faith-based institutions. President Obama believes that he should have that control. Our Constitution states otherwise
Just because you can come up with an accounting gimmick and pretend like religious institutions do not have to pay for the mandate, does not mean that you’ve satisfied the fundamental constitutional freedoms that all Americans are guaranteed."
